It is probably just "fair use" under US copyright law. But that is open to interpretation - and the rights owners devise cerative interpretations in their interest. It helps to make people nervous.
Should we be glad to have "closed" exception systems in Europe? They do provide more legal certainty. But they lack flexibility.
Remarkably, the TRIPS agreement (to be obeyed by all 160+ World Trade Organisation member states) allows copyright exceptions if the requirements of a "three step test"are met: "Members shall confine limitations or exceptions to exclusive rights to certain special cases which do not conflict with a normal exploitation of the work and do not unreasonably prejudice the legitimate interests of the right holder." (art. 13) The bad news is that this is utterly vague, and legislators implementing national laws compliant with TRIPS naturally prefer to stay on the safe side.

It is ridiculous, they are trying to use a anti-piracy law to the letter again, 4 minutes could probably be argued under fair use and it is obvious from the clips that she did not intend to record the movie according to the article.
