If you mean that the government should be free to alter the right after
creation if and when desired, changing the monetary value of the right, I
don't think there is a solution. Because that is exactly what human rights
like art. 1 of the first protocol to the ECHR and art. 14 of the German
Constitution protect ...
As I mentioned before, it may be possible to change what the
constition implies about this kind of case, by adding new articles
whose effect would be to prevent article 14 from applying to this
issue.
Also, any one privilege can be authorized for a year at a time, with
the possibility of renewal for additional years provided the law at
the time of renewal allows it. That would avoid the issue, for this
particular privilege.
