Does it protect intellectual property is the same as protecting an idea?
For a UK judge would seem so. A ruling by the Patents County Court
considered illegal English copy of "a substantial part of a photographic
work," ie, reproduce any photographs at the scene and the pose of an
original photo is a violation of the property intellectual.

The consternation of the British intellectual property law persists.
Judge QC, Colin Birss, failed to report a case where a photographer to
recreate the famous black and white image of the moving red bus on
Westminster Bridge and in front of the British Parliament, claiming that
"it was too unites similar picture and that has existing license. " The
photograph was part of the packaging of tea from a local firm.

The judge's argument that, according to British copyright law is an
infraction of "reproduction of a work in any material form", which until
now has been interpreted in the sense that it would violate literal
copying of a work registered, not recreate.

The big dilemma now is how to deal with this ruling, which has broadened
the definition of intellectual property infringement, proposing that any
claim legal rights to an idea. Intellectual property laws always tried
to avoid this, as it is for the universal copyright and should not be
linked to economic protection, such as "copyright".

>From this sentence, we conclude that some of the great images made
popular in the UK, as the Abbey Road album cover of The Beatles, one of
the images represented by tourists from around the world, could mean an
infringement with the consequences that it entails (fines, etc). So you
know, if they walk by Abbey Road, be careful not to mark the footsteps
of John, Paul, Ringo and George and avoid the flashes of tourists, lest
they end up being victims of some illegal image.

¿Proteger la propiedad intelectual es lo mismo que proteger una idea?
Para un juez de Reino Unido parecería que si. Un fallo emitido por la
Corte del Condado de Patentes inglesa considera ilegal la la copia de
“una parte sustancial de una obra fotográfica”, es decir, reproducir
cualquier fotografía en el lugar y en la pose de una foto original es
una violación a la propiedad intelectual.

La consternación de los abogados de propiedad intelectual ingleses aún
persiste. El Juez de Control de Calidad, Colin Birss, falló en un caso
donde se denuncia a un fotógrafo por recrear la famosa imagen en blanco
y negro del autobús rojo pasando sobre el puente de Westminster y por
delante del Parlamento Británico, aludiendo que “era demasiado similar
auna fotografía ya existente y que posee licencia”. La fotografía iba a
formar parte de los envases de té de una firma local.

El argumento del juez es que, según las leyes de propiedad intelectual
británicas, es una infracción la “reproducción de una obra en cualquier
forma material”, algo que hasta ahora había sido interpretado en el
sentido de que sería violatorio hacer copias literales de una obra
registrada, no de recrearlas.

El gran dilema que se plantea ahora es cómo lidiar con este fallo, que
ha ampliado la definición de infracción a la propiedad intelectual,
proponiendo que cualquiera reclame derechos legales sobre una idea. Las
leyes de propiedad intelectual siempre trataron de evitar esto, ya que
es competencia del derecho de autor universal, y no debería verse ligado
a una protección económica, como es el “copyright”.

De esta sentencia, se concluye que algunas de las grande imágenes que
popularizaron al Reino Unido, como la tapa del disco Abbey Road de Los
Beatles, una de las imágenes más representadas por turistas de todo el
mundo, podría significar una infracción, con las consecuencias que esto
acarrea (pago de multas, etc). Así que ya saben, si andan por Abbey
Road, tengan cuidado de no marcar los pasos de John, Paul, Ringo o
George y esquivar los flashes de los turistas, no sea que terminen
siendo víctimas de alguna imagen ilegal.
