During the last months we have attended with preoccupation the development of
<br>
the first draft of Law of measures of Impulse of the Society of the Information
<br>
(in ahead, LISI) due to numerous parts of its text that put in danger the
<br>
freedom of speech - when not fitting itself faithfully to article 20,5 of
<br>
the Spanish Constitution, that it establishes that seizure of publications,
<br>
recordings and other means of information will only be possible through court
<br>
decision -.
<br>
<br>
This Tuesday, that preoccupation has become indignation, when was revealed by
<br>
Internauts Association ( AI, acronym for "Asociacion de Internautas" ) what,
<br>
if confirmed, would be the penultimate liberticide attempt from the Spanish
<br>
Government: that performance rights organisations would be authorized by law,
<br>
so they would be allowed not only to block internet services and web sites
<br>
without a civil action, but even interrupting internet service for those P2P
<br>
users that the performance rights organisations would decide.
<br>
<br>
Although some mass media warn of possible elimination of the most controversial
<br>
article - just one among many other LISI articles that cause great concern -,
<br>
the fact that during both last years, and with spanish laws 19/2006 and
<br>
23/2006, the Government has created a legal system by and for the performance
<br>
rights organisations and even changing Criminal Procedure Law specifically to
<br>
favor those organisations that defend the miscalled Intellectual Property,
<br>
makes us suspect that this temporary break only responds to the Government's
<br>
fears from a political cost in the close local elections, and it makes us
<br>
suspect that from the 1st of June they will strike back beside the performance
<br>
rights organisations.
<br>

PIRATA will not accept any legislative initiative that violates the procedural
<br>
guarantees of the citizens nor violates other fundamental citizens' rights,
<br>
since performance rights organisations are not incumbent when talking about
<br>
blocking websites nor interrupting internet connection to anyone, being this
<br>
solely possible through court decision; and it fills us with a great concern
<br>
when neither PP ( Spanish Popular Party ), nor IU ( Spanish comunist party ),
<br>
nor nationalist parties have still stand against this frustrated attempt of
<br>
violating our fundamental rights; every minute, hourly, every minute, every
<br>
hour, every day that goes by without those parties stand brings a brand new
<br>
shadow of doubt towards the attitude of parties that - we must not forget it
<br>
- refused to stand a year ago against the demands of the performance rights
<br>
organisation reflected in the new LPI ( Spanish acronym for the Intellectual
<br>
Property Law ).

According to all the former reasons, PIRATA will work during the next days to
<br>
elaborate an rogatory to the Spanish Ombudsman, urging him to send an
<br>
unconstitutionality appeal to the Spanish Constitutional Court about several
<br>
sections of Law 19/2006 - that affects procedural guarantees and the power of
<br>
the performance rights organisations facing prosecution of supposed illegal
<br>
acts - altogether with the 1/1996 Decree of the miscalled Intellectual
<br>
Property - both sections introduced by recent Law 23/2006 and other sections
<br>
that already were there -; and we offer in those demonstrations that, by
<br>
democratic ways and respecting the Law, contribute to unveil what's happening
<br>
as well as leave crystal clear both Spanish Government and Parliament members
<br>
that never will be found acceptable such attempts against our fundamental
<br>
rights."<br>
