No, nobody was arrested. The only copied a few E-Mails from our<br>
(public!) mailinglist according to my information. And the server of<br>
that other party member was seized btw<br>

Party in the spotlight ? Existence of the ?Bayerntrojaner? confirmed<br>

A few days ago, Bavarian Police raided the private rooms of the press<br>
spokesman of the German Pirate Party (Piratenpartei Deutschland). Like<br>
in the "Cicero Case", the authorities were searching for a leaker in<br>
their own rows. In january during the discussion about the so called<br>
?Bundestrojaner? (Note: ?Federal Trojan?, a spy software for<br>
infiltration of private computers by state authorities), the Pirate<br>
Party released an internal document of the Bavarian department of<br>
justice received by an unknown person, which shows that such software<br>
might already be used without legal authorization. After the raid, the<br>
authenticity of this document can be considered confirmed.<br>

The situation is politically charged because of the affected person<br>
being a member of the executive committee of the Bavarian Pirate Party.<br>
The German Pirate Party repeatedly criticized this kind of spy software<br>
already. They further say, that there must be more parliamentary control<br>
over services like the BKA (Note: The German Federal Police, something<br>
like the US FBI) instead of more uncontrollable permissions for them, to<br>
prevent the civil rights from being undermined. Jens Seipenbusch, Vice<br>
Chairman of the PIRATEN says: ?This procedure can only be considered a<br>
repression of our political efforts. It looks like some of our state<br>
officials want to establish a surveillance state without the people<br>
noticing.?<br>

The raid of the Pirate Party's press spokesman's private rooms must<br>
therefore be considered an intimidation, especially since the<br>
investigators should have known, that he does not know the identity of<br>
the leaker. Moreover a server of another party member, which was hosted<br>
in Bavaria, was seized. The danger of information stored on this server<br>
being analyzed is low though, since it was encrypted with strong<br>
encryption software.<br>

Andreas Popp, Chairman of the Bavarian Pirate Party says: ?A brave<br>
person leaks documents to the Pirate Party, to inform the public about a<br>
procedure of the Bavarian Government, which is highly likely to violate<br>
the constitution. Now this persons is hunted like a criminal. Private<br>
rooms are raided, servers get seized. I want to tell this person, that<br>
measures have been taken to avoid unwanted access to data, which might<br>
lead to his or her identification.?<br>
