I don't know about GEMA, but the Dutch BUMA counterpart usually solves such
problems by imposing lump sums, amounting to a "citation tax". Obviously
that is NOT what we want. A "reduction ad absurdum" approach could be to
propose the idea that actually the copyright owner should *approve* the use
of its work (70K permissions!). But usually collecting societies simply
ignore that aspect of copyright.
Obviously, there should be a "fair use" exception similar to the U.S. Wich
is still a limitation: look at this:

Scholars started an action to advocate a more balanced application of the
"three step test":

(this test is a test that decides what copyright exceptions are acceptable
under TRIPS and the Berne Convention - the problem is that it is utterly
vague)
