I'd also like to mention that yes, this is true, but there another
important distinction to make.
The problem is that ACTA is preventing digital copies from floating
around on the internet, but counterfeiting infers that you're creating
fake items to compete with the original ones. For instance, when you
print counterfeit money, you're creating a fake copy to use or sell in
replacement for legitimate tender. When you download a copy of say,
your favorite album, it's unlikely that you nor the person distributing
the copy, is going to sell it to compete with the legitimate item by
burning it to a disc. Let alone, that when you do download that album,
you're downloading only the audio, and not making an exact copy of a
legitimate CD.

Just ranting, I guess.
