I guess you mean before the end of the commercial author's rights term. 
I mean, the /nc/ CC clause you talk about expires together with the rest 
of commercial rights -currently, after life+70 years; after PPI changes, 
would be a pretty shorter term-, i.e., when the work enters public domain.
