Similar problems are abundant in the current Internet. There are many 
things that ISPs could do to make the network better for users, such as 
caching popular content and thus aiding the workings of e.g. p2p systems 
(a hard balance here, though, to not give them power to harm their 
operation). However, they cannot do so or dare not do so, because they 
might be held legally responsible for commercial copyright violations.
