When he talks about "exceptional circumstances" he is talking about this
part of the text<http://www.laquadrature.net/wiki/EP_Flawed_Proposal_20091020>

But, as they say at La Quadrature, "exceptional circumstances",
"appropriate", "necessary" are vague terms and are very open to
interpretation. Those terms should be removed and replaced with others that
are crystal clear and specific.

When he says it contains "prior", I hope he's talking about "prior ruling by
the judicial authorities" , and in that case, I hope that the prior ruling
is also necessary even on "exceptional circumstances" and you all know what
I mean...
