Agreed.
Furthermore, your argument about indexers is poor at best. Google has
agents to handle takedown requests for YouTube, images, and the sites it
indexes. See Viacom v. Youtube. The Pirate Bay /prides itself/ on not
employing any takedown agents (thus not having the safe harbor clause).
I suggest that you peruse Professor James Boyle's The Public Domain
(particularly the chapter entitled "The Internet Threat"): he waxes
eloquently about the subject of Napster and Grokster.
