flat rate argument infers this:

1) file sharing is damaging the artists
2) the copyright system can be replaced by flat rate system
3) the flat rate system will support the creators

This three sentences is not true. First, filesharing does not damage the
artists, they  damages copyright industry business model. Second, Brazil and
many countries signed treaties that Impose mandatory copyright monopoly,
like genebra treaty and the TRIPS. Third, flat rate will have a major
problem in determining who are the "creators" and how they will be payed.
This is because many people  will not inteded to make money with their work,
and also because is impossible  determine accurately the number of downloads
to pay proportionately the artists.
