We condemn the use of any tactics that have been found to be illegal in a
court of law. We support the rule of law, and efforts to conform the law to
higher standard of justice and fairness.

To avoid endorsing DDOS doesn't require saying anything about it.

The problem I see with posting a statement specifically to condemn
DDOS is that it makes DDOS the focus of attention. That is where
the publishers want to put the focus, rather than on their wrongs.
We should always focus on condemning their wrongs and condemning
the laws that enable them to carry out these wrongs.

Thus, the only way making any statement about DDOS can serve the
cause is if we use it as an opportunity to bring the focus
back to where we want it.

Here's an example to show how that can be done:

We condemn taking down web sites, whether it is done by
denial-of-service attacks as Operation Payback does it, or by
lawsuits as the record companies do it. Both are wrong and both are
dangerous. Our focus is on the bigger danger of the record
companies, whose victims are web sites used by millions of people
  for sharing.
