You are right, the Air-Space above a country is controlled by this  
country. But the Air-Space only extends currently
to 100km above sea level. above this is space, and it is not regulated  
by any single country. (think of international waters) see http://en.wikipedia.org/wiki/Space_law 
  for an overview.
