[pp.int.general] The ‘private copying levy’ and European Union law

The Court of Justice of the European Union gave it's opinion on the
Spanish PADAWAN vs. SGAE case by saying:

"The application of the ‘private copying levy’ to reproduction media
acquired by undertakings and professionals for purposes other than private
copying is not compatible with European Union law"

Furthermore they justify a 'private copying levy’ for private persons buying
CD-R, CD-RW, DVD-R and MP3 devices etc. since they can presume to use the
devices to copy protected work and thereby cause harm to the author.
