I think there are a few things that need clarification.

1. Criminal Law vs Civil Law.

Commercial copyright infringement is a criminal offense and means you
can go to prison. Non-commercial infringement is a civil offense and
you cannot be put in prison for it.

2. Extradition.

You can be extradited following a request for extradition, if a court
rules that what you are accused of committing in the requesting
country would lead to criminal prosecution in the country you are
being extradited from.

3. Grounds for extradition.

If you are found to have engaged in criminal activity, or operated in
a particular country, you may be tried under their system. If I lead
an organised crime group in the United States, yet reside in
Australia, I may still face trial there.

4. Kim Dotcom.

Is considered a commercial copyright infringer. Therefore he faces
criminal prosecution. His crimes are illegal under New Zealand law, so
he may be extradited. The US allege he had substantial operations in
the United States and so he will face prosecution there.
