Of course, the quote about avoiding "American mistakes" *must never* be
used without context. On the other hand, Eva Lichtenberger is right when
she points out that Europe is eager to copy everything the USA did
wrong, but reluctant to imitate the stuff they did right (which is a lot).
Being anti-american is a bad thing, comparable to racism or nationalism.
Giving reason to the impression that pirates were anti-american must be
avoided.
In the context of DMCA and PATRIOT act there are many obvious mistakes
to avoid. And it is a shame that such mistakes are copied by the
European Commission without sufficient democratic participation of the
people that will be affected by those mistakes.
