I found this German article intriguing in argumentation.

Germany has not implemented the EU data retention directive yet
(mostly due a ruling by the federal constitution court) and is thus
probably facing a legal case before the European court.
The article argues that there should be no in the EU the rule of law
has not yet been implemented as in national states, e.g. in Germany.
